Terms
All orders shipped pre-paid. If the payment is to be of an unsecured
fund, Moran Motorsports will demand payment 10 days prior to delivery. No products(s) will be released to customer
until payment in full is received.
Orders
Order desk hours
are 9:00 AM - 6:00 PM EST Monday thru Friday.
Check Policy
All returned
checks will be assessed a $25.00 service charge plus any other fees incurred
in the collection of the item.
Customers sent to collections will be charged a $50.00 fee minimum or
as allowed by law and may be responsible for all fees incurred during the
collection. Any unpaid NSF checks will
be subject to collection and legal action.
Refusals
All refusals will
have a $25.00 handling charge and applicable freight charges billed to the
customers account.
Drop Ship Orders
Factory drop ship orders will be subject to
the manufacturer’s policy and an additional fee may apply. Please contact the
Moran Motorsports directly.
Special Orders
All special
orders are subject to freight and handling charges from the manufacturer. No
returns accepted on special order parts.
Returns
Returned items on
a case by case basis. Please contact
Moran Motorsports directly for information about returns. Prior authorization is required. Returned items must be unused and may be
subject to a restocking fee.
Credit Agreements
If credit is approved and provided for
in-house work, It is agreed as follows:
Buyer agrees with Moran Motorsports,
Inc. to pay for all purchases upon receipt of Invoice. Charges billed, but
not paid by the 30th day from date of invoice will be considered delinquent
and subject to finance charges.
The FINANCE CHARGE for individuals is computed
by a periodic rate of 1.5% per month which is applied to the "Previous
Unpaid Balance less Current Credits." Current credits are payments or
credits received by 12:00 A.M. on the 30th day of the following month. The
minimum payment due will be payment of Buyer's indebtedness in full. If not paid,
Moran Motorsports, Inc. may declare the unpaid
balance due and payable immediately. Buyer agrees to pay collection expenses,
including reasonable attorney's fees and court costs, if it is necessary to
collect through legal action.
Buyer assumes full responsibility for all
materials purchased from Moran Motorsports, Inc.
Buyer agrees to be personally liable for all charges and individually
guarantees payment of all charges promptly. Buyer agrees to notify Moran Motorsports, Inc. within 7 days in writing of receipt of
invoice. Failure to so notify Moran Motorsports,
Inc. signifies total acceptance and responsibility for prompt payment in full
of account.
If materials are ordered to be delivered, the
buyer assumes liability for the materials at the time of delivery whether or
not buyer's representative is on hand to acknowledge receipt of delivery.
Buyer agrees to pay standard delivery charges as billed.
Moran Motorsports,
Inc. reserves the right to send out "Notice to Owners" and file
Liens on past due accounts and use any legal means available to force
collection if necessary.
Warranty
Warranty & Legal
Statement: The only warranties
applying to this part(s) or service are those which may be offered by the
manufacturer. The selling dealer
hereby expressly disclaims all warranties, either express or implied,
including any implied warranties or merchantability or fitness for a
particular purpose, and neither assumes nor authorizes any other person to
assume for it any liability in connection with the sale of this part(s)
and/or service. Buyer shall not be
entitled to recover from the selling dealer any consequential damages,
damages to property, damages for loss of use, loss of time, loss of profits,
or income or any other incidental damages. Due to the nature of their use, racing parts
are not covered by warranty once they have been used. No refunds will be
given on shipping charges.

Moran
Motorsports, Inc. Makes no warranties…
either express or implied, including any warranty of merchantability of or
fitness for a particular purpose. There is no warranty expressed or implied
as to whether the goods sold hereby will protect purchaser or ultimate user
of such goods from injury or death. Racing is a dangerous activity and the
user shall determine the suitability and safety of the product for its
intended use, and the user assumes all responsibility and risk in connection
there within. The purchaser is
responsible for determining the suitability of any and all products purchased
from Moran Motorsports, Inc. There is
no warranty stated or implied due to the unusual stresses places on race cars
and components and we have no control over how they are installed,
maintained, and used. Due to the
hazards involved with racing, Moran Motorsports, Inc. accepts no liability
for failures of racing components or accessories manufactured or sold by
Moran Motorsports, Inc. or any of its Distributors. Upon purchasing this product(s), customers
accept all risks involved with racing and hazards thereof.
